Performance can be compared at an aggregate level without claiming the same individual moved from one database to the other.

This framework does not approve an Amazon package insert, listing link, QR code, warranty-registration flow, coupon, or external destination. Those touchpoints can implicate several Amazon policies and laws. An authorised seller should review the exact current policy and creative before deployment.

Phase one: stabilise the Amazon channel

Document every system and person with access to Amazon order information. Remove marketing-platform feeds that cannot be justified for fulfilment. Restrict exports, set deletion controls, and review Buyer-Seller Message templates against Amazon's Communication Guidelines.

Use Amazon-native aggregate insight for decisions inside Amazon. Amazon says Brand Analytics offers dashboards for search, repeat purchase behaviour, market baskets, demographics, and loyalty insights to eligible brands. The data can guide catalogue, content, inventory, and eligible native promotion decisions without creating an external customer list.

Treat account health as a migration guardrail. The Seller Code says policy violations can lead to actions including listing cancellation, suspension or forfeiture of payments, and removal of selling privileges. A channel strategy that jeopardises the existing marketplace business is not a durable migration.

Phase two: build independent DTC demand

Create a useful DTC destination before buying traffic: clear product information, delivery and return terms, support, accessibility, privacy notices, and a secure checkout. Then acquire visitors through sources the brand controls or contracts for independently of Amazon buyer data. Maintain source-level records so the team can show how each contact arrived.

Offer an email or account relationship only with transparent value. A subscriber should understand the message type and be able to decline without losing an unrelated service. For EU and EEA audiences, the European Commission's official consent guidance explains the conditions for valid consent. Other lawful bases and national electronic-marketing rules require separate analysis.

Do not use an Amazon-origin touchpoint merely because a competitor does. If packaging or another Amazon surface is proposed, collect the current first-party policy text for that marketplace, document how the destination works, and review diversion, communication, review, incentive, customer-data, and privacy issues. Omit the touchpoint if the source does not support it.

Phase three: operate separate customer records

Keep provenance with every DTC profile: source, date, notice version, affirmative action, purposes, and withdrawal status. Centralise suppression across the email platform, CRM, support desk, and agencies. Limit access, set retention, and ensure vendors receive only the data they need for the documented purpose.

For US commercial email, the FTC's CAN-SPAM business guide covers accurate headers, non-deceptive subjects, advertisement identification when required, a postal address, a clear opt-out, and timely opt-out processing. CAN-SPAM does not replace stricter consent or privacy rules elsewhere.

Design reporting without prohibited identity stitching. Amazon can be measured with Amazon's aggregate dashboards; DTC can be measured from brand-collected records. Define repeat purchase, customer, revenue, returns, and time windows separately, then compare trends with the definitions visible. Do not call aggregate movement proof that particular Amazon customers migrated.

Phase four: allocate by customer value, not channel ideology

Decide the role of each channel. Amazon may serve marketplace discovery and convenience; DTC may support a broader catalogue, richer education, or a consented lifecycle. Those are strategic possibilities, not promises. Evaluate margin, service load, fulfilment, returns, acquisition cost, retention, cash flow, and platform risk using the brand's actual data.

Set guardrails before shifting budget: Amazon availability and service must not deteriorate; DTC acquisition must use documented sources; marketing must map to permission; and no workflow may import Amazon buyer information. Qualified counsel should review the Amazon agreement, marketplace policies, privacy notices, direct-marketing rules, and any proposed cross-channel touchpoint before launch.

The outcome is not a transferred list. It is a healthier channel mix: Amazon customers are served properly on Amazon, while a distinct DTC audience chooses the brand through a lawful, transparent path.
